The right to refuse is the consumer's right to withdraw unilaterally from the agreement within a certain period without giving reasons.

I. The right of refusal:

  1. You have the right to withdraw from this agreement within 14 (fourteen) days without explanation, provided that the original packaging of the product has been preserved.
  2. The right of withdrawal expires 14 days after the date when you purchased the goods, or a third party, other than the carrier and designated by you, took possession of the goods.
  3. If you want to exercise your right to refuse, you shall inform us, SIA "BSO GROUP", (enterprise number 44103124095, legal address – Engures iela 1-2, Jūrmala, LV-2016, email: info@bstore.eu) about your decision to terminate the contract by email.
  4. To invoke the right to refuse, it is enough that you send a notification on exercising the withdrawal right until the term of the withdrawal right is expired.

II. The refusal effects:

  1. If you cancel this contract, we will refund the price of the goods, excluding delivery costs. The cost of returning the goods to our warehouse is the responsibility of the buyer.
  2. You need to send the goods to the bstore.eu warehouse without undue delay, and in any event no later than within 14 days from the day when you let us know of your decision to withdraw from this contract. The term will be kept if you return the goods to the bstore.eu warehouse before the 14-day term expires. Please note that SIA "BSO GROUP" has the right to record possible visual damage to the goods as well as the package contents for goods sent by mail at the time of their delivery. In cases when the goods were sent to the bstore.eu warehouse by courier, SIA "BSO GROUP" discovers that the goods are damaged or are different by the appearance and package contents at the time of delivery, you will be informed about this and provided with a copy of the report. Už prekių grąžinimą ir visas grąžinimo išlaidas atsako pirkėjas.
  3. You only bear responsibility for decreasing the value of the goods if the goods have been used for purposes different from determining features and checking the functionality of the goods.
  4. Throughout the period of execution of the right of refusal, you have the right to use the product to the extent necessary for checking its features and functionality (to the same extent as before purchasing the product in a physical retailer). By exercising your right of refusal, you carry responsibility for any use of the product beyond that is meant to check the features and verify the functionality of the product. You carry responsibility for using the product throughout the period of execution of the right of refusal, which is incompatible with the duty of good faith, as well as for decreasing the value, quality, and safety of the product.
  5. You carry responsibility for maintaining the quality and safety of the product throughout the period of exercising the right of refusal.

  7. Save as provided in clause 12 of these rules, you can exercise the right of refusal and unilaterally withdraw from the contract within 14 days, covering:

11.1. costs of the goods delivering via a method that is not the cheapest standard delivery method offered by SIA "BSO GROUP";

11.2. direct expenses of returning goods, except where SIA "BSO GROUP" agrees to cover these expenses or does not inform you that you must cover these expenses;

11.3. the decrease in the value of the product, if the product was not used in order to check its characteristics and verify its functionality, which is proved by an examination carried out by the experts of the product seller. You do not carry responsibility for the decrease of the product’s value if SIA "BSO GROUP" has not informed you about the right of refusal according to the procedures established by regulatory acts executing consumer rights protection.

III. The consumer cannot exercise the right of refusal:

in the cases described in clause 22 of the Cabinet of Ministers Regulations No. 255 of May 20, 2014 "Rules on Distance Contracts", including if:

  • the price of the product is subject to financial market fluctuations which cannot be controlled by the seller and which may occur during the period of the right of refusal;
  • the goods have been produced according to the consumer’s specific instructions or are clearly personalized;
  • the product is perishable or its life will soon expire;
  • the product, due to its properties, will irreversibly be mixed with other items after delivery.
  1. The online retailer bstore.eu does not keep the copies of sale and purchase contracts;
  2. You can fill a purchase order in Russian and Latvian.
  3. Forms on exercising the right of refusal are published on the website of SIA "BSO GROUP" www.bstore.eu.

 

IV. Out-of-court settlements


16. You can send a complaint about the availability or the quality of the goods at info@bstore.euThe complaint will be reviewed within 14 working days from the date of receiving the complaint. A response will be sent to the contact address provided in the complaint.

17. If the complaint is found unreasoned, and you disagree to accept the complaint as unreasoned, you are entitled to use the alternative dispute resolution options specified in the regulatory acts by submitting a written application to the Company for out-of-court dispute resolution, providing:

  • your full name and contact information;
  • the application filing date;
  • the point of the dispute, your requirements, and foundations for them.
