Provision of warranty
THE WARRANTY
1. This guarantee is granted by BSO GROUP SIA with its registered office in Avotu iela 34B, Riga, LV-1009, Latvia with registraIon number 44103124095, hereinaMer referred to as the GUARANTEE.
2. The guarantee is granted for new equipment and furniture and related accessories. The guarantee does not cover other goods offered through the bstore.eu
3. For businesses and individuals - self-employed The warranty is granted for a period of 12 months from the date of delivery of the goods purchased at bstore.eu. In case of a warranty event, please contact BSO GROUP SIA. immediately by e-mail (info@bstore.eu) or by phone +371 24820328.
4. The GUARANTEE shall be liable for defects resulIng from hidden manufacturing or material defects of the goods, found during the warranty period provided that: a) the goods have been used in accordance with their intended use, operaIng instrucIons and have been properly maintained (all upholstered furniture should not be cleaned/maintained with preparaIons containing alcohol), b) the equipment recommended by the GUARANTEE has been used, c) the goods have not been disassembled or modified by third parIes not authorized by the GUARANTEE, d) the work with the goods has not been conInued aMer the first symptoms of the defect have occurred, e) the serial number was not damaged in a way that makes it unidenIfiable, f) the goods have not been removed or modified by third parIes not authorized by the GUARANTEE. g) the factory number was removed, obliterated to an extent which makes it impossible to idenIfy that number or the factory seal was not removed, h) the goods were not overloaded as a result of excessive or improper use, i) the goods were not mechanically damaged, flooded with liquids or dusted, j) the person enItled under warranty did not know about the defect at the Ime of conclusion of the sales contract.
5. The warranty does not cover: a) power supply cables, b) communicaIon cables, c) electric heaters, thermostats, d) replacement of wearing out parts (e.g. filters, bearings spindles, commutators, brushes, fuses, bulbs, gaskets, accumulators, hairdresser`s washer baderies), e) faults caused by overvoltage or overload of electrical network.
6. If a physical defect is found during the warranty period, the warranty holder may demand that the goods be repaired. In parIcularly jusIfied cases the GUARANTEE may decide to replace the goods with new ones.
7. The GUARANTEE may refuse to saIsfy a claim under the warranty for the recIficaIon of a defect if the cost of fulfilling this claim exceeds the price paid for the goods.
8. In order to realize the rights under the warranty, the person enItled under the warranty is obliged to deliver the goods to the GUARANTEE`s registered office or to an authorized service together with a complaint. The costs of delivery of goods purchased in the course of conducIng business acIvity shall be borne by the holder of the guarantee. The person enItled under the guarantee is obliged to properly pack the goods in order to protect them from damage, as well as to properly release the adverIsed goods if they are collected by the GUARANTEE or another enIty acIng on its behalf.
9. The basis for the warranty claim to be accepted is a properly filled-in warranty card with proof of purchase by the seller.
10. A complaint report should include: a) a detailed descripIon of the defect and the circumstances under which the defect was found, b) personal data and address of the person enItled under the guarantee.
11. If the complaint does not contain data that would enable the complaint to be properly dealt with, the GUARANTEE shall call the person enItled under the guarantee to complete the complaint within at least 10 days. The deadline for the GUARANTEE to fulfill its obligaIons under the guarantee shall run from the date of compleIng the complaint by the person enItled under the guarantee.
12. The goods delivered by the person enItled under the guarantee should be clean and, in a condiIon, allowing the complaint to be considered. In case of delivery of dirty goods, the warranty will be considered aMer cleaning the goods at the expense of the person enItled to the warranty at the rates specified in the price list, aMer prior consent of the person enItled to the warranty was granted. The deadline to perform the obligaIons under the warranty then starts from the day of cleaning the goods. In the event that the person enItled from the warranty refuses to allow the GUARANTEE to clean the goods, the goods shall be returned at the expense of the person enItled under warranty.
13. The GUARANTEE is obliged to perform the obligaIons arising from this guarantee within 31 days from the date of delivery of the goods by the person enItled under the guarantee. The date of performance of obligaIons under the guarantee shall be deemed to be the date on which the person enItled under the guarantee is noIfied of the performance of those obligaIons.
14. In the event of an unjusIfied demand by the person enItled under the guarantee, the GUARANTEE shall noIfy the enItled person within the period indicated in point 13. about refusing to perform warranty repairs.
15. In the case of personal collecIon, the person enItled under the warranty is obliged to collect the goods (at the GUARANTEE`s registered office or at an authorized service centre where the warranty noIficaIon was made) within 10 days from the date of noIficaIon of the GUARANTEE`s performance of warranty repair or refusal to perform warranty repair.
16. In the event of failure to collect the goods within the period referred to in point 15. the GUARANTEE shall call upon the righful owner to collect the goods within a specified addiIonal period of not less than 14 days.
17. The risk of accidental loss of or damage to the goods during the period between the handing the goods to the GUARANTEE and their collecIon by the person enItled under the warranty shall be borne by the GUARANTEE.
18. In case of necessity to make repairs not covered by the warranty, the repair may be made by the GUARANTEE at the cost of the person enItled under warranty, aMer obtaining the wriden consent of the person enItled under the warranty and accepIng the price of the diagnosis and the price of the repair of the goods.
19. The rights under the guarantee expire if the person enItled under the guarantee does not report a defect in the goods within 30 days from the date of its detecIon.
20. The warranty rights are vested in the buyer who purchased the goods directly from the GUARANTEE.
21. This warranty does not exclude, limit or suspend the rights of the person enItled under the warranty under the provisions of the warranty for defects in goods sold.
